Dear Brothers and Sisters of District 141,
Our hearts are heavy today as we share the sad news of the passing of Assistant General Chair and our friend and Brother Richard Pascarella. He died suddenly on Saturday in his hometown of Pittsburgh, Pennsylvania.
Brother Pascarella started his career at United Airlines in 1989, where he joined IAMAW Capital Lodge 1759 in Herndon, VA. He began serving IAM members as Shop Steward, and later held leadership positions at the local lodge as Educator, EAP Representative, Grievance Committee Chair, Vice President and President. He was elected Vice President of the Virginia State Council of Machinists and later joined the leadership of District 141 as a Trustee. Brother Rich also served as District 141 Vice President, East and was elected Assistant General Chair in 2014.
As a life-long dedicated unionist and passionate advocate for working men and women, Brother Rich Pascarella will be remembered for his warm and gracious demeanor and his vibrant personal style. He will be deeply missed. Please keep his family in your thoughts and prayers during this difficult time.

The City of New York is taking American Airlines to court, saying that the carrier is illegally punishing workers when they get sick.
According to the lawsuit, American Airlines is illegally retaliating against workers who call in sick under the city’s safe and sick leave laws. The carrier is also guilty of violating the law by not allowing employees to use the sick time they have accrued and demanding private medical information.
The city is seeking approximately $375,000 in restitution for more than 750 ground crew workers, including fleet service and mechanical employees, as well as civil penalties.
“American Airlines has violated their ground crew’s rights by engaging in practices that make workers afraid to exercise their rights because they will be disciplined for using a sick day,” Commissioner Lorelei Salas said in a statement released on Thursday.
“Not only are these practices illegal, but it is disappointing when an employer puts business above their own employees’ health,” Commissioner Lorelei continued. “We will not tolerate any employer that violates employees’ rights to their paid safe and sick leave.”
New York City employers cannot punish workers for using sick time accrued under the city’s sick leave laws. Covered workers can accumulate up to 40 hours per year. New York’s Department of Consumer and Worker Protection (DCWP) found that American Airlines violates this law when it charges workers with “Attendance Points” for calling in sick. Workers that use too many Attendance Points in a calendar year will lose their jobs, meaning that Attendance Points are a severe disciplinary measure.
American issued a statement defending the practice of retaliating against employees who use their accrued sick time, saying, “employees enjoy generous sick leave and benefits, including those set by union contracts with terms that are often more generous than required by the New York law.”
The company did not respond to questions from union members who asked which union contracts allow the company to deny accrued sick time in violation of the law. The company also did not explain how this would be “more generous” to union members.
Under New York City’s Paid Safe and Sick Leave Law, businesses with five or more employees who work more than 80 hours a year in New York City must provide paid sick leave to employees.
According to Commissioner Salas, this includes American Airlines, regardless of what their company policies may say. “American Airlines is not above the law,” said Commissioner Salas. “Workers in major transportation hubs where thousands of people pass through every day should not have to choose between going into work sick or getting in trouble for exercising their right to take a sick day.”
Employers may not engage in or threaten retaliation against employees, which includes firing and any act that punishes an employee for using the law. It is also illegal for a company to take any action that is likely to deter an employee from exercising his or her rights under the law.

Agreements in Principle
Sisters and Brothers,
After more than four years of bargaining, the TWU-IAM Association is proud to announce we have reached Agreements in Principle with American Airlines for five new joint collective bargaining agreements (JCBAs) worth $4.2 billion, covering more than 30,000 Mechanic & Related, Fleet Service, Maintenance Control, MLS/Stores and Maintenance Training Specialist members.
The Association negotiating committees must finalize and proof contract language on agreed upon provisions of the tentative contracts, and the parties will continue to meet to accomplish that task. This process could take a few weeks. Preliminary highlight sheets are attached to this bulletin, but the final, complete contract language will be available to all members. In addition to being posted on union websites, the complete agreement will be mailed to each member’s home before voting begins.
After the final language is finalized, membership ratification details and voting information will be announced.
When negotiations began, the Association negotiating committees were faced with the tremendous challenge of combining dissimilar, mature contracts negotiated by different unions with different airlines into JCBAs for the new American Airlines. From the outset, we had a decision to make: get a quick agreement, or get the right agreement for Association members, regardless of how difficult, lengthy and contentious that process would be. As you review the complete terms of the contracts, you will see that we chose the correct path.
Your negotiating committees recommend the ratification of these agreements.
These Agreements in Principle will provide all Association members with wages, benefits, work rules, job security and retirement income that had never before been accomplished. Total compensation (wages, premiums, retirement, and profit-sharing) is the richest in the industry. Not only are all Association members’ jobs protected in their locations, but more importantly, we were able to protect the work we do. The considerable benefits to all members will be immediately apparent.
Nothing in these Agreements in Principle would have been possible without the support, solidarity, and patience of the membership. We ask for your continued patience as we complete and proof every word so you can be presented with all the information you need to make an informed decision when you vote on ratification.
