I want to take this opportunity to introduce myself to all of you. I am Joshua M. Javits, a full-time professional mediator and arbitrator. I am a member of the National Academy of Arbitrators, a roster arbitrator for the American Arbitration Association and Federal Mediation and Conciliation Service, and a former Chairman and Member of the National Mediation Board. By agreement between American Airlines and the TWU/IAM Associations representing Mechanic and Related, Stores, and Fleet Service Employees, I was appointed as a Neutral to assist the parties in the seniority integration process resulting from the merger of American Airlines and US Airways.

According to federal law, known as the McCaskill-Bond Amendment, in airline mergers the integration of seniority must be fair and equitable. The law further provides that when the employees of a craft and class at the two merging carriers have the same representative, in this case the TWU/IAM Associations, the merger policy of the representative shall be applied. Here, the parties have already established the basic principles to guide this seniority integration in their April 24, 2013 Agreement Regarding Seniority List Integration, specifically that the primary basis for seniority integration will be the date of entry into an employee’s basic classification. In May 2016, the parties further agreed upon a procedure to implement their 2013 Agreement and appointed me to act as the Neutral in that process.

The seniority integration process agreed to is less formal and more cooperative than a standard arbitration proceeding and will involve several phases.

  1. Initially, I will engage in a fact-finding process in order to understand employees’ current seniority arrangements and identify potential issues impacting the integration of seniority lists. As part of this process, I have already requested certain background information from the Company. In addition, on June 21, 2016, I met in Washington, DC with the Associations’ seniority integration committees and joint collective bargaining teams, which include members from both pre-merger Carriers. These were very productive sessions and I appreciate the participants’ insights regarding potential issues and areas of concern.
  2. Also, as part of the fact-finding process, I will consider any written comments or information regarding the integration of seniority lists that any employee represented by the TWU/IAM Associations wishes to submit. Comments must include: employee name, employee number, job title, and station. Comments must be sent by regular mail or email to the following so they are received no later than July 31, 2016:

  1. Once the fact-finding process is complete, I intend to engage further with the Associations’ seniority committees in order to reach consensus on the integration of lists to the fullest extent possible.
  2. At the conclusion of this fact-finding andmediation process, I will issue a Report and Recommendations regarding the integration of seniority, as well as proposed integrated lists. The Report and the proposed lists will be promptly published to the membership for review.
  3. Following the publication of the proposed lists, affected employees will have 45 days to file in writing any protest they may have regarding their placement on the list. Details regarding how to file a protest will be provided in conjunction with the publication of the proposed lists.
  4. I will consider all timely filed protests and issue a final and binding determination with respect to each. After deciding all protests, I will issue final integrated seniority lists, incorporating any necessary adjustments or corrections in light of my protest determinations. It is intended that the final lists will issue by December 1, 2016. However, the Company has agreed that it will not implement the final lists until new joint collective bargaining agreements have been reached and ratified.

Throughout this process, I will be assisted by the Washington, DC law firm of Guerrieri, Clayman, Bartos & Parcelli, P.C., which has extensive experience in airline seniority matters. I look forward to assisting the parties in achieving a fair and equitable seniority integration.

In other news this week, the TWU-IAM Association met this week in Washington D.C. to continue the seniority integration process. This follows efforts that began with our joint TWU-IAM seniority committee who met last November. The work of that committee initiated the seniority integration process and identified issues and differences in need of further attention in order to reach final integrated seniority lists.

Based on the committee’s work and in order to establish final fair and equitable seniority lists, the Association decided to obtain assistance from an experienced and nationally recognized Neutral to analyze, make recommendations and, if necessary, decide seniority issues in accordance with our earlier seniority integration commitments and agreements.

To conduct this comprehensive analysis and to create final integrated seniority lists, the Association has obtained the services of Joshua M. Javits. Javits is a former Chairman and member of the National Mediation Board, member of the National Academy of Arbitrators and a neutral on the labor arbitration panels of the American Arbitration Association and the Federal Mediation and Conciliation Service. Mr. Javits has unrivaled practical experience issuing reports and recommendations regarding the fair and equitable integration of seniority.

Mr. Javits will review and analyze the seniority committee’s work thus far, will gather information from the Company and will work with the Association to prepare final integrated seniority lists.

Javits will introduce himself to the Association membership in his own communication to you. There, he will further describe his responsibilities in this process and how input from members can be provided to him. Also, he will advise of the process to protest one’s placement on the list(s), once issued, in order to make corrections where errors may have occurred.

Sisters and Brothers,

The Fleet Service Association Negotiating Committee met with American Airlines during the week of June 20th in Washington, D.C.

The week began with a seniority integration meeting at the TWU International office, which included the Seniority Integration Committee, the Negotiating Committee and other representatives of the Association. The Seniority Integration Committee will continue its work in parallel with joint contract negotiations.

As we returned to the table with American Airlines, the company forwarded its proposal regarding holidays, which fell far below the expectation of the membership considering the record profits American Airlines continues to post quarter after quarter. Using the strength of the Association’s crafts and classes, we jointly developed appropriate proposals in response that leverage our solidarity. It is now up to the company to respond accordingly, and we will continue to push back until they offer us the consistency to treat all crafts and classes equally. We will not allow the company to divide us!

We also received the company’s proposal on overtime, and we are currently evaluating it and devising a response. Additionally, we exchanged another round of proposals on the Hours of Work article that unfortunately did not bring us any closer to a tentative agreement. As you can see, we are now getting into the more contentious articles of this contract, and we will continue to hold the line on behalf of our members.

Our next negotiating session is scheduled for the week of June 27th in Dallas.

The International Association of Machinists and Aerospace Workers (IAM) today announced that approximately 190 fleet service workers at Spirit Airlines overwhelmingly ratified their first, complete contract today.

An interim agreement covering wages, job security, union security, benefits, and the grievance process / system board of adjustment (arbitration) process was in place, after being ratified in June of 2015. The new, complete Contract also addresses job scope, hours of service & overtime, seniority, uniforms, safety and health, among other things.

The four-year contract runs through June of 2020. Besides providing the group their first, complete collective bargaining agreement, they now have a solid platform to build on.

Our entire Union thanks those members that participated in the station voting process. We especially thank the members of the Negotiating Team for their hard work to bring back an overwhelming endorsement from the members.

District 141 will certify the ratification votes on Tuesday, June 28, 2016.

The Association Fleet Negotiating Committee met with the company this week in Dallas. Multiple proposals were passed that addressed the outstanding issues regarding Hours of Work and Work Schedules. We made significant progress on both of these articles.

Your committee also worked on proposals for Overtime and Classifications. The company indicated that they are preparing to pass their Overtime proposal during our next session.

Our next negotiating session is scheduled for the week of June 20th in Washington DC.
